DRUG CRIME DEFENSE

PROTECT YOUR RIGHTS

WHAT DOES A DRUG OFFENSE CONVICTION MEAN TO YOU?

Simple Possession-loss of license for 2 years
Sale or Delivery-loss of license, prison, loss of job or apartment
Trafficking-mandatory prison, deportation, huge fines
An attorney is important
Employers use a drug conviction as the number one reason to deny you a job.
Apartment owners use any conviction to deny housing.
The government uses drug convictions to deport you or deny you re-entry into the U.S.
An experienced, aggressive attorney can help you navigate the minefield of a drug charge, and may be able to help you keep your license and avoid jail or prison.
Don Waggoner has defended thousands of drug charges and dozens of trafficking charges. Let him use that experience to help you.

DUI DEFENSE

FORMAL REVIEW HEARING

Why Is It Important?

You only have 10 days
It's the only way you can get your license back
You get at Least 30 more days to Drive
An attorney is important
Your DUI ticket gives you ten days to drive and ask for a formal review hearing. Requesting a hearing gets you another 30 days to drive-valuable time if you need to make arrangements for not having a license.

At the hearing, a hearing officer will hear the facts and make a finding of whether you were legally arrested. If the officer finds in your favor, you will get your license back.

If the hearing officer doesn’t find in your favor, what happens?

If you gave a voluntary breath test, you will lose your license for 6 months, and must wait at least 30 days before you can get a temporary (business purpose) license.
If you refused the breath test, your license will be suspended for 1 year, and you must wait 90 days to get a temporary license.
In either case, you must take the DUI class to get a temporary license or your permanent license back.
Remember, the administrative suspension of your license is different than the suspension the court gives.

Should You Hire a Lawyer or Bond Out First?

Hire the lawyer first.  He might be able to get your bond lowered and he is much more important to you in the case than the bondsman is.

Save the bond money for your attorney.  Your attorney does not want to leave you in jail.  Your attorney will be there to help you seek a lower bond, and then to advocate and fight for your innocence and freedom.  If you do get convicted, only your attorney will be there to fight for a lower sentence.  Only your attorney will listen to your side of the story and present it in your defense in court.

And you won't be able to afford an attorney if you spend all or most of your money on the bondsman.
